1. Rashid (the appellant) challenges the legality and correctness of a judgment dated 15.09.2000 of learned Addl. Sessions Judge in Sessions Case No. 116/98 arising out of FIR No. 431/98 PS Sultanpuri whereby he was convicted for committing offences punishable under Sections 304/324 IPC. By an order on sentence dated 19.09.2000, he was awarded RI for seven years with fine ` 1,000/- under Section 304 IPC and CRL.A. 583/2000 Page 1 of 13 RI for one year with fine ` 500/- under Section 324 IPC. Both the sentences were to operate concurrently.
2. Allegations against the appellant were that on 03.07.1998 at about 08.00 A.M. opposite Hanuman Mandir, P-4 Block, Sultanpuri, he and his associate Harish Kumar inflicted injuries to Anil Kumar, Ghanshyam and Dhani Ram. Dhani Ram succumbed to the injuries and post-mortem examination on the body was conducted. During the course of investigation, statements of the witnesses conversant with the facts were recorded. After completion of investigation, a charge-sheet was filed against the appellant and Harish Kumar for committing offences under Section 304/324/34
