Crl. M.A. No.17083/2015 (Exemption) Exemption allowed, subject to all just exceptions. Accordingly, the application is allowed.

CRL.M.C. 4745/2015

1. Vide the present petition filed under Section 482 of the Code of Criminal Procedure, 1973, petitioners seek quashing of FIR No.99/2012 registered at Police Station Barakhamba Road, New Delhi for the offences punishable under Sections 420/120B of the IPC and the consequential proceedings emanating therefrom against them.

2. Learned counsel appearing on behalf of the petitioners submit that the aforesaid case was registered on the complaint of respondent No.2, due to certain property transaction. The police has filed the chargesheet Crl.M.C. No.4745/2015 Page 1 of 8 against petitioners. Meanwhile, the respondents No.2 has amicably settled their disputes with the petitioners before Mediation Centre, Patiala House Courts, New Delhi vide settlement agreement dated 06.11.2015 for a total sum of Rs.34.00 Lac. Pursuant to said settlement, an amount of Rs.4.00 Lac had already paid by petitioner to respondent No.2 during settlement proceedings. Another payment of Rs.10.00 Lac is being made today through draft bearing No.404484 dated 17.11.2015 in favour of respondent No.2 drawn on HDFC Bank, which has not been disputed by respondent No.2.
