1. By way of this petition filed under Section 482 of the Code of Criminal Procedure, 1973, petitioners seek quashing of FIR No.458/2009 registered at Police Station Rajouri Garden, Delhi, for the offences punishable under Sections 498A/406/494/313/34 IPC and the consequential proceedings emanating therefrom against them.
2. Learned counsel appearing on behalf of the petitioners submit that the aforesaid case was registered on the complaint of respondent No.2, namely, Smt. Paramjeet Kaur, consequent upon certain matrimonial and domestic disputes having arisen between the parties. The case is at the Crl.M.C. No.2013 /2015 Page 1 of 8 initial stage of trial as charge sheet has been filed. Meanwhile, the respondent No.2 and the petitioners have amicably settled their disputes vide Memorandum of Understanding ('MoU') dated 25.08.2014, for a total sum of Rs.8,00,000/- (One Lacs). As per the said settlement, two instalments of Rs.2,00,000/- (Two Lacs) and Rs.3,00,000/- (Three Lacs) have been paid at the time of recording first motion petition and second motion petition respectively for divorce by mutual consent and the balance amount of Rs.3,00,000/- (Three Lacs) is paid today in the Court by way of demand draft bearing No.501406 dated 26.08.2015, drawn on ICICI Bank, Rajouri Garden, New Delhi, copy of draft has been placed on record, which facts have not been disputed by the respondent No.2.
