1. By way of this petition filed under Section 482 of the Code of Criminal Procedure, 1973, petitioners seek quashing of FIR No.78/2008, registered at Police Station Nanakpura, New Delhi, for the offences punishable under Sections 498A/406/34 IPC and the consequential proceedings emanating therefrom against the petitioners.
2. Learned counsel appearing on behalf of the petitioners submits that the aforesaid case was registered on the complaint of respondent No.2, namely, Smt. Nishpreet Kaur, consequent upon certain matrimonial and domestic disputes having arisen between the parties pursuant to her marriage dated 04.11.2006 with the petitioner No.1, Sh.Chanpreet Singh Chadha. After completion of investigation, the chargesheet has been filed by the police, charges have been framed and the matter is pending for prosecution evidence. Meanwhile, the respondent No.2 and the petitioners have amicably settled their disputes vide Settlement/Compromise dated 06.12.2013 arrived at before the Mediation Centre, Tis Hazari Courts, Delhi, for a sum of Rs.13,00,000/- (Rs.Thirteen Lacs). Out of which Rs.10,00,000/- (Rs. Ten Lacs) have already been paid to the respondent No.2 and an FDR for the balance amount of Rs.3,00,000/- (Rs. Three Lacs) has been handed over to the respondent No.2 today in Court. Consequently, marriage between the petitioner No.1 and the respondent No.2 has been dissolved vide decree of mutual divorce dated 09.03.2015 under Section 13 B (2) of the Hindu Marriage Act, 1955 and thus, respondent No.2 does not wish to pursue her case against the petitioners.
